Question:

When a vehicle is protested, and the item or component in question has to be shipped out for testing, does the competitor have the right to compete at other NTPA events until the tests come back? Or does the vehicle remain impounded until the tests come back? This could affect a points race for only a $500..00 fee.

Answer:
As of 3/21/09 the Joint Executive Boards of NTPA / WPI have made the following ruling:
(this takes effect immediately)

1. If the vehicle’s component in question cannot be tested in the field and has to be shipped out for testing, the cost of a protest is raised to $1000.00 cash.

a. If the vehicle’s component in question cannot be tested in the field, the vehicle will be allowed to compete with the impounded components replaced by other components during the testing period.

b.
The protest fee will be applied to the testing and shipping. All points and monies for said vehicle accumulated during testing period will be held until the tests are complete.

c. If tests come back and the vehicle in question is found to be legal, all points and monies accumulated during testing period will be reinstated. A processing fee of $500.00 will be deducted from the Protest fee and the remaining $500.00 will go to the protested vehicle.

d. If tests come back and the vehicle was in violation of the rule, the purse monies that were held will be applied towards cost of shipping and testing. The protester will be reimbursed the full $1000.00 protest fee. The remainder of purse money held (if any) will be applied to end of season point monies for that division and level and not be re-applied to the purse of the events the vehicle ran during the testing period.
(Intent: the monies could cause the re-writing of many checks).
